How does the recent change to the Open Meetings Act affect five-member boards and commissions?


Answer: P.A. 95-245, effective, August 17, 2007, amends the definition of "meeting" for five-member boards and commissions, so as to permit two members of such bodies to talk to each other without violating the OMA. For other, larger public bodies, the definition of a meeting is "a majority of a quorum" gathered to discuss public business. In the case of five-member boards and commissions, a majority of a quorum is two, so no two members could ever talk to each other about public business without violating the Act. The new definition, applicable only to five member public bodies, boards and commissions, is "a quorum" rather than "a majority of a quorum." Since two members do not constitute a quorum of a five member body, they can talk without violating the Act.

However, three members do constitute a quorum, and so a meeting could take place even if two members were absent. In order to prevent two members attending a meeting from being able to control voting when two members are absent, the OMA is also amended to require that, in a five member board or commission, THREE AFFIRMATIVE VOTES ARE REQUIRED TO APPROVE ANY MOTION, RESOLUTION OR ORDINANCE, unless a greater number is otherwise required. So if two members are absent, two vote yes and one votes no or abstains, the motion fails, because there are not three AFFIRMATIVE votes. (An abstention is not an affirmative vote.)
