Bio: Donald W. Anderson has been a labor and employment law attorney
since 1973, concentrating in employment litigation and in representing public
sector clients with respect to labor and employment law matters, including collective
bargaining, grievance arbitration, interest arbitration, employment law compliance,
and representation before state labor relations boards. More recently, he has
gained experience in municipal law, and has developed expertise in the application
and administration of Title IX of the Education Amendments of 1972.
Mr. Anderson has represented such public sector clients as municipalities,
fire protection districts, sanitary districts, library districts, park districts,
state governments and government agencies, universities, and community colleges
in a variety of labor and employment matters. He has engaged in representation
proceedings and/or collective bargaining with municipal employee unions such
as the FOP, PBA, OCSEA, IAFF, SEIU, AFSCME and IET in four states, (Illinois,
Iowa, Ohio, and Florida), and he has represented municipal and community college
clients in fact-finding and interest arbitration proceedings (primarily involving
police and firefighters) in the states of Illinois, Iowa and Wyoming. In addition,
he has represented private and public sector clients in labor board proceedings
(NLRB and state labor relations boards), labor department proceedings (such
as Fair Labor Standards Act investigations and litigation, and state department
of labor wage claims), and EEOC and state fair employment practices commission
proceedings.
In his employment litigation practice, Mr. Anderson He has been involved on
behalf of both plaintiffs and defendants in prosecution or defense of claims
arising under the Fourteenth Amendment to the United States Constitution, Titles
VI and VII of the Civil Rights Act of 1964, as amended, the Age Discrimination
in Employment Act of 1967, as amended, the Civil Rights Acts of 1866 and 1871
(42 U.S.C. §§ 1981, 1983, and 1985), and various state constitutional
and statutory provisions relating to civil rights and unlawful discrimination.
Mr. Anderson has represented class and individual clients in federal courts
in cases arising under Title IX of the Education Amendments of 1972 and in state
courts in cases involving disputes between amateur sports organizations and
their affiliations with national organizations.
Civil rights cases in which Mr. Anderson has participated include Vuyanich
v. Republic National Bank of Dallas, 723 F.2d 1195 (5th Cir.), cert. denied
105 S.Ct. 567 (1984), a case termed by one observer as "the most sophisticated
statistical case in the history of Title VII litigation," and EEOC. et
al. v. AT&T Technologies, Inc., Nos. 78 C 3951 and 82 C 1542 ()N.D. Ill.)
(The AT&T National Maternity Leave Case).
In his municipal practice, Mr. Anderson served as Village Attorney for the
Village of Antioch, Illinois from May, 2001 to January, 2003. In that capacity,
he provided legal assistance to the Village in dealing with a number of complicated
land-use issues and in defending the Village against and helping the Village
to settle two major multi-party lawsuits involving development projects.
Mr. Anderson is the author of Title VII Class Actions: The End of the Era of
the Irrelevant Plaintiff, 36 MERCER L. REV. 907(1985), and Does the Scope of
Relief Available under 42 U.S.C. Section 1981 Threaten the Purposes and Policies
of Title VII's Remedial Scheme? In Title VII at Twenty-Five (BNA, 1989), and
is co-author with James Baird of Practical Labor Relations for Public Employers
(Colorado Municipal League, 1978) and with John T. Weise, Robert C. Long, and
Jeffrey S. Heller of Surviving Police/Fire Collective Bargaining and Interest
Arbitration in Illinois (Illinois Association of Chiefs of Police and Illinois
Fire Chiefs' Foundation, 1985).
