Bio: Derke J. Price is a partner with the Firm. Mr. Price is a 1988 graduate of Harvard Law School and actively represents units of local government and developers and businesses as both corporate counsel and special counsel.
Mr. Price was admitted to the bar by the Supreme Court of the State of Illinois and the United States Circuit Court for the Northern District of Illinois in 1988. His training includes 5 years as second chair for various international reinsurance arbitrations and 17 years of primary responsibility for client relationships, corporate work, and trial work for various clients related to their corporate mission, construction issues, land use, contracts and regulatory matters. In addition to his governmental clients, Mr. Price continues to represent large private industry clients on construction and land use matters.
Mr. Price as represented various units of local government in various matters since 1993. He is presently the corporate counsel for the Village of South Elgin, special counsel for the Village of Bellwood, and formerly the corporate counsel for the Villages of Hainesville and Beach Park. He is the corporate counsel for the Naperville, Oswegoland, Batavia, Sycamore, DeKalb, and Bloomingdale Park Districts and is Special Counsel to the Glenbard Wastewater Authority, the Central Lake County Joint Action Water Agency, and the York Center Park District, the City of Batavia and numerous other municipalities and park districts on issues concerning construction, land-use and zoning, and pollution control facilities. He is the past Chairman of the Planning Commission for the City of Naperville and his practice concentrates in land-use and construction matters (including the siting of pollution control facilities and commercial aggregate production facilities) and also includes business and regulatory matters; purchases and bidding; construction administration and finance; insurance; and grant funding issues.
Mr. Price has litigated a wide variety cases for his clients, including a jury trial tried to verdict concerning construction defects and claims for extras. In representing the Owner against claims by the Contractor, the award was within amount set for reserve and 1/3 amount demanded by plaintiff. Mr. Price has also recovered substantial sums for his Owner clients through both litigation and arbitration concerning defects in construction. He has successfully tried eminent domain cases and property rights cases. He has also defended his clients in various chancery cases contesting the validity of their ordinances or land use decisions and secured the dismissal of these challenges. Mr. Price has successfully handled coverage litigation for various insured matters and numerous contract cases. Mr. Price has also successfully argued appeals before the Appellate Court.
Mr. Price has contributed materials to numerous publications for Municipal Officials, Planning and Zoning Authorities, Park District Officials, Townships and School Districts on land use and construction. He is an author for various publications of the Illinois Institute of Continuing Legal Education. He has conducted training sessions for public works directors on construction issues and for planning and zoning authorities concerning land use regulation and administration. He has authored several pieces of legislation enacted into law.
