Bio: Derke J. Price actively represents municipalities, park districts, school districts and other various local units of government and special private parties in their corporate and business affairs, and in particular in those matters related to the use and development of land, including construction disputes.

He is the Chairman of the Plan Commission for the City of Naperville.

He serves as the Village Attorney for the Village of South Elgin and the Village of Hainesville. He is the Corporate Attorney for the Batavia Park District, Oswegoland Park District, Sycamore Park District, and DeKalb Park District. He is special counsel to numerous other units of local government and certain land use and development clients. He also advises and represents owners, developers, institutions, contractors, and design professionals in the arbitration, litigation and negotiation of zoning and land use issues, commercial contracts, construction contracts, life-safety issues, labor agreements, regulatory affairs, procurement packages and appeals at all levels.

Particular highlights include: Enforcement of liquidated damages for delay clause, for the benefit of a park district; recovery of $125,000 due to construction defects or other hazards for school district and its insurer; negotiation of $6.3 million and $2.2 million state grant funding contracts for school district; and litigated, arbitrated and/or negotiated payment/close-out of numerous contracts for school districts.

Mr. Price is a frequent speaker on issues related to land use and development and is the author of the chapter on Construction Contracts in the IICLE Handbook "Municipal Law and Practice In Illinois."
